Terms and Acceptable Use

Effective date/version: REQUIRED OPERATOR INPUT · Draft 0.15.1

1. Operator and agreement

YardMate is provided by REQUIRED OPERATOR INPUT: legal entity name, registration details, business address and legal/support contact (“Operator”, “we”, “us”). By using YardMate you agree to these Terms and acknowledge the Privacy Notice. A business/stable customer that uses YardMate to process personal data about staff, riders or other people must also enter into the Business Data Processing Addendum where data-protection law requires it.

2. Eligibility and authority

You must have legal capacity to use the service. If you use YardMate for a stable, stud, employer, club or other organisation, you confirm you are authorised to act for it. Stable Owners and Managers must only invite/provision people, assign roles and enter personal data when they have authority to do so. Minor-user/guardian rules and the minimum age for any direct account use: REQUIRED OPERATOR INPUT AND LEGAL REVIEW.

3. What YardMate provides

YardMate is an organisational record system for personal horse management, stable operations, Stable Hand tasks, horse care records and foreground ride tracking. It is not veterinary, medical, legal, employment, safeguarding, emergency, navigation or safety advice, and it is not an emergency-location or lone-worker monitoring service. Qualified human judgment remains required for animal welfare, treatment, staffing and safe riding/work practices.

4. Accounts, roles and security

Use only your own account and keep your PIN confidential. Stable Hands use a stable access code plus a personal PIN; the access code is a selector, not permission to bypass the Stable Hand role. Stable Owners/Managers must use the least privilege needed, review memberships, and remove access promptly when a person leaves or changes role. Platform Admin access is reserved for authorised YardMate operations. Report suspected compromise to REQUIRED OPERATOR INPUT: security contact. You must not attempt to defeat authentication, role checks, stable boundaries, rate limits or other security controls.

5. Customer data responsibilities

You remain responsible for the lawfulness, accuracy and authority of data you submit. Do not enter information merely because a free-text field permits it. In particular, do not enter unnecessary human medical information, ethnicity, religion, criminal history, sexual-life information, children's data or other sensitive/special-category data unless the relevant controller has confirmed the required lawful basis, notices, safeguards, guardian arrangements and any regulatory permission. Horse veterinary information is not automatically human health data, but it may become personal data if it identifies a person.

Where a free-text rider name is recorded for another person, YardMate requires the user to attest that they are authorised to record that identity and that any required guardian/legal permission for a minor is in place. The attestation is logged with the responsible user and time. This product control does not replace the stable/controller's legal duty to decide whether minor data may be processed at all.

Business customers are responsible for providing required privacy information to their staff/riders, choosing their lawful bases, respecting individual rights, and instructing YardMate as processor where applicable. The Operator remains responsible for its own controller obligations described in the Privacy Notice.

6. Photos, notes and location

Upload only photos/files you are authorised to use and avoid unnecessary images of identifiable people. Do not put secrets, PINs or unrelated personal data into horse/task notes. Precise ride location is optional and user-triggered. If a business asks workers to use location features, that business is responsible for a lawful and proportionate policy and must not conduct covert worker monitoring or other hidden/excessive monitoring. Do not rely on the web/PWA for continuous background GPS, emergency rescue, lone-worker protection or safety-critical tracking.

7. Records, ownership and data control

Users and business customers retain the rights they hold in content they submit. They grant the Operator only the rights reasonably needed to host, secure, back up, process and display that content to authorised users and to comply with law. Stable-owned horse/task/audit records may continue to exist after an individual leaves where the stable has a lawful retention need; personal identifiers should be removed or minimised where appropriate. The account-removal process is described at /delete-account.

The current product does not sell customer personal data, does not use advertising trackers, and does not use customer personal data to train general-purpose AI models. Any materially different future use requires an updated legal assessment and notice before it starts.

8. Acceptable use

You must not: access another stable or person's data without permission; share another person's PIN or impersonate them; secretly monitor a person; falsify care, work or audit records; upload unlawful, abusive, infringing or malicious material; introduce malware; scrape or bulk-extract data without authority; probe or attack the service without written authorisation; bypass technical limits; use the service to violate privacy, employment, safeguarding, animal-welfare or other law; or use YardMate in a way reasonably likely to harm people, animals, records or systems.

9. Data protection and business processing

The Privacy Notice explains the Operator's handling of personal data. Where the Operator processes personal data on documented instructions from a business controller, the DPA applies when incorporated into the customer agreement. A customer must not instruct the Operator to process data unlawfully. International transfers, subprocessors, retention and data-subject-request responsibilities must be documented for the actual production deployment before launch.

10. Third-party services

Production may rely on hosting, database/object storage, security/monitoring, support and app-store providers. The final provider/subprocessor list and any third-party terms are REQUIRED OPERATOR INPUT. YardMate must not represent a third-party service as providing guarantees it does not provide.

11. Availability, changes, suspension and termination

The service may be updated, interrupted or restricted for maintenance, security, abuse prevention, legal compliance or operational reasons. We may suspend compromised or seriously abusive access. Customer termination rights, notice periods, data-return window, fees, refunds, support levels, service commitments and any trial terms: REQUIRED OPERATOR INPUT. Termination does not remove obligations that by their nature continue, including lawful retention, confidentiality, intellectual property and dispute provisions.

12. Intellectual property

Customer content remains subject to the rights of its owners. YardMate software, design, documentation, trademarks and other Operator materials remain owned/licensed by REQUIRED OPERATOR INPUT. No licence is granted except the limited right to use YardMate under these Terms. Open-source components remain governed by their own licences.

13. Warranties, liability and indemnities

Warranty scope, exclusions, liability caps, exclusions of indirect loss, indemnities, insurance expectations and any business/consumer distinctions: REQUIRED OPERATOR INPUT AND QUALIFIED LEGAL REVIEW. Nothing in these Terms excludes or limits liability or statutory rights where doing so would be unlawful, including mandatory consumer rights where applicable.

14. Governing law, disputes and language

Governing law, courts/arbitration, pre-action complaint process and any consumer forum rights: REQUIRED OPERATOR INPUT AND LEGAL REVIEW. The controlling language if English and Arabic texts differ: REQUIRED OPERATOR INPUT. The Arabic text below is a convenience draft and requires legal-linguistic review before launch.

15. Changes to these Terms

Material changes will be posted with an updated effective date and, where appropriate, notified in-product before they take effect. Changes will not be used to hide a materially different use of personal data; privacy changes are handled under the Privacy Notice and applicable law.

16. Contact

Legal notices, support and complaints: REQUIRED OPERATOR INPUT.
